Virtual immunity for the dishonest

As Frank Partnoy says in his Comment ‘Grubby lessons from a life of serial fraud' (April 9), financial pyramid schemes are everywhere.  Many firms of solicitors have teams specialising in civil fraud.  Furthermore, a great deal of civil litigation has, underpinning the basic facts, dishonest conduct by the defendant of his associates.

Mr Partnoy says that most people do not start massive pyramid schemes because they have a sense of right and wrong.  This may be true, but nevertheless there is a significant deterrent, not just in the prospect of criminal prosecution, but of civil litigation by the losers.
